Use of the website

By using the website, you become a user. The user accepts, on using the web page, the terms and conditions herein.

The website does not collect or request personal data from users to access it.

The user undertakes to make diligent and appropriate use of all content and services on the website, in accordance with the law, morality, public order and the provisions in these terms of use, and by refraining from using them in such a way that they may prevent, damage or deteriorate the normal functioning of the website by other users, that could affect or cause damage to the property and rights of ERSI or any other third party.

In addition, by way of example and not limited to, the user undertakes in the use of the website to:

a) not introduce or disseminate content or information of a racist, sexist, xenophobic, pornographic, libellous, obscene nature or that involves advocacy of terrorism, incites violence or is prejudicial to human rights, crimes against public decency, public order or the law in force;

c) not use the website, its content and, in particular, the information obtained through the website, to send advertising or commercial messages, or data of third parties.

Intellectual and industrial property

The elements contained or used therein are protected by intellectual and industrial property rights and, therefore, the user undertakes to respect such rights.

The user may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow the public access through any form of public communication of any of the above-mentioned goods and contents protected by industrial and intellectual property, without the authorisation of the holders of the relevant rights.

Exclusion of guarantees and liability

ERSI shall act diligently, according to the generally accepted uses, to prevent presence in the website of viruses or other harmful elements that may cause alterations in the computer system of the user, but it cannot guarantee the absence of such elements, and is not liable for any damages that might result therefrom.

ERSI shall only be liable for damages the user may suffer as a result of the use of the website when such damages are attributed to wilful misconduct on the part of ERSI. The user acknowledges and accepts that the use of the website is at its sole risk and responsibility.

Including but not limited to, ERSI shall not be liable for any damages that may arise from:

a) any damage or malfunction caused by the computers and devices of the user caused by reasons beyond ERSI’s control;

b) disruptions or blockages in the use caused by deficiencies or overloads in Internet or in other electronic systems;

c) damage caused by third-parties through illegitimate actions in the website; and

d) impossibility of providing the service or allowing access for reasons not attributable to ERSI, due to the user, to third parties, or cases of Force Majeure.

In the case of links or hyperlinks to other Internet sites, ERSI has no control over such sites and content, nor shall it assume any liability for the damages that may arise from the access and use of such sites.

The inclusion of these links or hyperlinks does not imply, per se, any kind of association or participation of ERSI with the linked sites.

ERSI may at any time modify these terms of use and publish the new conditions of use on the website. After modifying the terms, use of the website by the user shall mean acceptance of the latter of the modified terms of use.

Applicable legislation and jurisdiction

The provisions contained in these terms of use shall be governed by and construed in accordance with the rules in force in each moment in the Grand Duchy of Luxembourg and any dispute shall be submitted to the courts and tribunals of the Grand Duchy of Luxembourg.
